Platform Terms & Conditions

1. Introduction and Acceptance

These Terms of Service (“Terms”) govern your access to and use of the websites, digital learning platforms, streaming services, mobile applications, and related services operated by When in Culture Ltd (“WiC”, “we”, “us”, “our”) (together, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
WiC provides a digital platform for educational content delivery and does not act as an educational institution, immigration advisor, or employment provider.
Content provided through the Services is for informational purposes only and does not constitute legal, immigration, or professional advice.
Use of the Services is also subject to our Privacy Policy and, where applicable, separate agreements with Partner institutions.

2. Nature of the Services

The Services provide educational, preparatory, and informational content, including structured learning modules, video content, assessments, and digital certifications.
The Services may be used:

  • directly by individual users; or
  • via a university, education provider, agent, sponsor, employer, or other organisation (“Partner”).
Certain courses may be required by a Partner institution as part of its internal processes (for example, pre-arrival preparation or onboarding workflows).
The Services may include links to or content provided by third parties. We are not responsible for the content, accuracy or availability of such third-party materials.

3. Access via Partners

Where you access the Services through a Partner:

  • your access may be provisioned or managed by that Partner;
  • completion of specific courses or activities may be required by that Partner;
  • WiC operates the platform and content delivery;
  • the Partner remains responsible for its own decisions, policies, and processes.
For the avoidance of doubt:
  • WiC does not control Partner decisions relating to admissions, visas, compliance, or employment;
  • your use of the Services does not guarantee any outcome with respect to such decisions.
Partners may require evidence of completion (such as a certificate) to be submitted as part of their internal processes.

4. Accounts and Registration

To access certain features, you must create an account.
You agree to:

  • provide accurate and complete information;
  • keep your login credentials secure;
  • notify us of any unauthorised use of your account.
You are responsible for all activity on your account.
You are responsible for ensuring that you have the necessary devices, software, and internet access required to use the Services.

5. Educational Content, Assessments and Certification
The Services may include:
  • structured learning modules;
  • assessments, quizzes, or knowledge checks;
  • progress tracking;
  • digital certificates of completion.
5.1 Certification Certificates of completion are issued based on:
  • platform activity;
  • completion of required modules;
  • assessment performance (where applicable).
5.2 No Guarantee of Outcomes Completion of any course or issuance of a certificate:
  • does not guarantee admission, visa approval, academic success, employment, or any other outcome;
  • is provided as evidence of participation and engagement with WiC content only.
5.3 Personal Completion Requirement You must complete courses and assessments personally. You must not:
  • impersonate another individual;
  • allow another person to complete content on your behalf;
  • attempt to manipulate or falsify results.
WiC reserves the right to invalidate certificates or restrict access where misuse is suspected.
Where you submit content to the Services, you grant us a non-exclusive, worldwide, royalty-free licence to use, store and display such content for the purposes of operating and improving the Services.
6. Acceptable Use
You agree not to:
  • use the Services for unlawful or harmful purposes;
  • interfere with the operation or security of the platform;
  • attempt to access unauthorised areas of the Services;
  • copy, distribute, or exploit content for commercial purposes without permission.
We reserve the right to monitor usage and to apply reasonable usage limits to ensure fair and secure access to the Services.
We may suspend or terminate access where these Terms are breached.
7. Intellectual Property
All content within the Services, including:
  • videos;
  • course materials;
  • assessments;
  • platform design;
  • software and systems,
is owned by or licensed to WiC.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Services for personal or authorised institutional use.
You may not:
  • reproduce, modify, or redistribute content;
  • use content for commercial purposes;
  • extract or reuse content outside the platform.
Institutional use is governed by separate Licence Agreements.
8. Data and Reporting
WiC processes personal data in accordance with its Privacy Policy.
Where access is provided via a Partner:
  • WiC may share limited information with that Partner, including:
    • course progress and completion status;
    • high-level engagement metrics relating to WiC content.
Such data:
  • does not form part of formal academic records;
  • is limited to WiC platform activity;
  • is used by Partners at their own discretion and under their own policies.
9. Platform Availability
We aim to provide a reliable service but do not guarantee uninterrupted access.
We may:
  • modify, update, or suspend the Services;
  • restrict access for maintenance or security reasons.
We reserve the right to modify, update, replace or remove any content, courses or features within the Services at any time.
10. Payments (if applicable)
Where you purchase access directly:
  • payments are processed via third-party providers;
  • fees are non-refundable except as required by law.
Institutional access is governed separately by Licence Agreements.
11. Disclaimers
The Services do not provide legal, immigration, financial, or professional advice.
Eductional content is provided for general guidance and learning purposes only.
We do not guarantee outcomes (including admissions, visa decisions, academic performance, employment, or accreditation) unless expressly stated in writing.
Content may include opinions or perspectives which do not necessarily reflect the views of When in Culture.
12. Limitation of Liability
To the maximum extent permitted by law:
  • the Services are provided “as is”;
  • WiC is not liable for indirect or consequential loss;
  • WiC is not responsible for decisions made by Partner institutions.
For individual users, liability is limited to the greater of:
  • fees paid by you in the preceding 12 months; or
  • £100.
Nothing excludes liability for death, personal injury, or fraud.
WiC shall not be liable for any reliance placed on certificates or course completion data by any third party, including Partner institutions.
Nothing in these Terms shall limit or exclude any liability which cannot be limited or excluded under applicable law.
13. Termination
We may suspend or terminate your access:
  • for breach of these Terms;
  • for misuse of the Services;
  • where required for legal or security reasons.
You may stop using the Services at any time.
We may temporarily suspend access to the Services where reasonably necessary for security, maintenance, or operational reasons.
14. Relationship with Other Agreements
Where access to the Services is provided via a Partner institution:
  • separate contractual agreements (including licence agreements) may exist between WiC and that Partner;
  • those agreements govern the commercial and institutional relationship;
  • in the event of conflict, those agreements shall prevail over these Terms.
15. Changes to the Services or Terms
We may update these Terms from time to time.
Where changes are material, we will provide notice via the Services or by email.
Continued use of the Services constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
17. General

Entire Agreement
These Terms, together with the Privacy Policy and any applicable Partner or Licence Agreements, constitute the entire agreement between you and When in Culture in relation to your use of the Services.

Variation
We may update these Terms from time to time. Updated Terms will be posted on the Services and will take effect from the date stated.

Assignment
We may assign or transfer our rights and obligations under these Terms to an Affiliate or in connection with a merger, acquisition, or sale of assets. You may not assign or transfer your rights under these Terms without our prior written consent.

Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

No Waiver
Any failure or delay by us in enforcing any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Third-Party Rights
A person who is not a party to these Terms has no right to enforce any provision under the Contracts (Rights of Third Parties) Act 1999.

Force Majeure
We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control.

Relationship
Nothing in these Terms creates any partnership, joint venture, or agency relationship between you and When in Culture.

18. Notices
We may provide notices to you by:
  • email to the address associated with your account;
  • notifications within the Services; or
  • publication on our website.
You are responsible for ensuring that your account information, including your email address, is kept up to date.

20. Intellectual Property Complaints
We respect the intellectual property rights of others and expect users of the Services to do the same.
If you believe that any content available through the Services infringes your copyright or other intellectual property rights, please notify us by providing:
  • a description of the work or material you believe has been infringed;
  • a description of where the material is located within the Services;
  • your contact details (including name and email address);
  • a statement that you have a good faith belief that the use is not authorised by the rights holder; and
  • a statement that the information provided is accurate and that you are authorised to act on behalf of the rights holder.
We will review all such notices and may remove or restrict access to the relevant content where appropriate.
